1. Introduction

1.1 By confirming your booking with Into Country Tours Pty Ltd, a registered South African tour operator led by Janina and Gary Parker, you agree to adhere to the following terms and conditions. Please review and accept these terms for a seamless booking experience.

Into Tours operates as a trusted ground handler, managing all aspects of tours, including transportation, activities, and local guides, to ensure a seamless and memorable experience. We collaborate with select tour operators to enhance our offerings while maintaining high standards of service.

 

3. Contract and Booking Terms

3.1 These terms and conditions apply to all bookings and become effective upon confirmation.

3.2 Rates are valid until December 2025 and are quoted in South African Rand (ZAR).

3.3 Tour rates include transportation, a tour guide, bottled mineral water, and specified expenses. 

3.4 Entry fees and attraction tickets are charged separately, and the fee can be included to your tour cost 

3.4 Additional costs may apply to outlying towns or provinces.

 

4. How to Book:

4.1 Complete the Online Booking form, accepting on behalf of all parties the terms of these booking conditions, and pay the total tour fare per person. No contract shall exist between the company and the client until the prescribed payment has been made and the client's booking has been confirmed by the company. The payment will be refundable should the company be unable to accommodate the client on the requested tour

 

5. Pick-up Points:

5.1 We can collect you from airport, harbour, or any guesthouse in the tour city area.

5.2 Collection outside the main city area is available at an additional cost, subject to availability.

5.3 Please provide your pick-up location when making a booking.

5.4 Be ready for pick-up 15 minutes before your chosen departure time.

 

6. Reservations and Payment

6.1 A 20% deposit is required to confirm bookings, with the final payment due seven days before the tour date.

6.2 Payments can be made via Visa, MasterCard, or bank transfer. All credit card transactions are securely processed through WeTravel.

 

7. Payment & Refunds:

7.1 Full payment of the tour fare must be made at the time of booking. Otherwise, the company may treat the booking as cancelled by the client. Late applications may join the tour on an availability basis.

7.2 Refunds are at the sole discretion of Into Country Tours Pty Ltd, however are considered on the following basis:

Where cancellations are agreed upon prior to tour commencement, the following refund schedule applies:

6–4 weeks: 20% fee of the total tour price is charged
4–2 weeks: 50% fee of the total tour price is charged
2 weeks - 7 days: 80% fee of the total tour price is charged
6 days - 24 hours (including no-shows): No refund
 

8. Group Size

8.1 Scheduled safari and day tours are shared experiences unless booked as a private tour. Group sizes range from a minimum of 2 to a maximum of 10 participants per vehicle. In some instances, guest may be seated in 23 seaters with maximum of 18 people, in the case of large groups and seat-in tours.

8.2 Special group rates are available for groups exceeding 10 travellers, and team leaders tour for free. For inquiries, contact [email protected].

8.3 Solo travellers may join group tours. If no group is available, the tour will proceed as a private tour, and the solo traveller will be charged at the two-person rate.

 

9. Alterations to Itineraries:

9.1 While every effort is made to adhere to advertised itineraries, the company reserves the right to change routes and accommodations due to changing conditions. In the case of major changes, clients will be notified as soon as possible. 

9.2 The company also reserves the right to alter an itinerary after departure if it is in the client’s best interest. 

9.3 The company will not be held responsible for compensation if a tour is cancelled or changed due to force majeure, including war, riot, industrial dispute, terrorism, natural disasters, adverse weather, or other external circumstances beyond the company's control.

 

10. Authority on Tour / Exclusion from Tour:

10.1 The decision of the company’s driver-guide is final in all matters concerning client safety.

10.2 The company is not responsible for any client who engages in illegal or unlawful acts in the country visited. Such clients may be excluded from the tour without refund.

10.3 If a client causes inconvenience or annoyance to others, the company may, at its discretion, cancel their booking and cease carrying them further.

 

11. Alterations:

11.1 No employee or representative of the company has the authority to alter or waive these conditions unless in writing and signed by the company director.

 

12. Health:

12.1 Clients must be medically fit, in good health, and able to undertake the tour.

12.2 Pre-existing medical conditions must be declared at the time of booking. Clients with medical conditions must provide a statement from a GP confirming fitness to travel.

12.3 The company will treat all health information in strict confidence.

 

13. Baggage:

13.1 All baggage and personal effects are the client's responsibility. The company is not liable for loss or damage to baggage or personal belongings.

 

14. Insurance:

14.1 Travel and cancellation insurance is mandatory for all clients.

14.2 Clients must arrange their own insurance before departure to cover injury, medical expenses, loss of luggage, and trip curtailment.

14.3 The company will not provide refunds in cases of illness, death, or injury.

 

15. Indemnity:

15.1. Outdoor activities and tours place clients in direct contact with nature and other unpredictable factors.

15.2. The company, its employees, guides, and agents are not responsible for personal loss, damage, injury, accident, death, delay, or inconvenience.

15.3. Clients take full responsibility for their actions and agree to abide by company instructions at all times.

15.4. Clients waive their right to legal recourse against the company, its employees, guides, or agents.

15.5. The company is not liable for any losses, injuries, or damages under any circumstances.

15.6. While tours are structured for safety and enjoyment, the company is not responsible for injuries or damages arising from negligence or any other cause.

 

16. Minors (under 18 years):

16.1 Legal guardians must provide consent and have full legal authority to contract on behalf of the minor.

16.2 Child rates apply to children under 12 or where stipulated otherwise by sub-contractors or third party activities / service providers.

16.3 Children aged six and older can join open-vehicle game drives or where stipulated otherwise by sub-contractors or third party activities / service providers..

16.4 The company provides appropriate vehicles and booster seats for child safety, but prior arrangement needs to be made.

16.5 Parents/guardians are responsible for supervising children throughout the tour.

16.6 No alcohol will be served to travellers under 18 under any circumstances.

 

17. Shore Excursions:

17.1. We accommodate cruise ship schedules with flexible cancellation policies and a back-to-ship guarantee.

17.2. Tour start and end times align with the cruise ship itinerary. Into Tours reserves the right to change the itinerary to suit cruise ship arrival / departure. 

17.3. No refunds whatsoever are issued for changes in cruise ship itinerary / schedule. 

 

18. Meeting Point & Reminders:

18.1. A reminder message with the meeting location will be sent before your tour.

18.2. Shore Excursions are exclusive to cruise ship passengers for a seamless experience.

 

19. Copyright:

19.1 The company may take photos or videos of clients during tours and reserves the right to use them in advertising without client consent or payment.

19.2 All content on the company’s website (text, images, videos) is owned by Into Country Tours Pty Ltd. Reproduction or distribution without permission is prohibited.

19.3 The company holds exclusive trademark and copyright rights for all brand-related content.

 

20. Jurisdiction & Law:

20.1 This contract shall be interpreted under the laws of South Africa. In the event of any dispute, the English version of this contract shall be the governing document.

 

21. Severability:

21.1 If any term or provision of this contract is found to be illegal or unenforceable, the remainder of the contract remains valid. If any covenant is deemed excessive in scale, extent, or duration, it shall be adjusted to the maximum permissible level.

 

22. Indemnity & Waiver:

22.1 By confirming your booking, all guests or group members acknowledge and agree to these terms and conditions. Further on-site waivers and indemnities may be required on-site. 

 

23. Gratuities

23.1 Tipping is not mandatory but appreciated. A 10% tip is standard for good service.

 

24. Booking Confirmation:

24.1. By confirming your booking, you automatically agree to these terms and conditions, without the need to sign a waiver or indemnity form.

25. Complaints & Disputes:

25.1. Complaints should be sent to [email protected]. The company follows a transparent dispute resolution policy.
